The European Convention on the Exercise of Children's Rights is based on the United Nations Convention on the Rights of the Child , which entered into force on September 2, 1990 and obliges the contracting states to take all appropriate legislative, administrative and other measures to implement the measures specified in the UN Convention on the Rights of the Child to meet recognized rights.

The European Convention on the Rights of the Child contains procedural measures designed to give children the opportunity to assert their rights and provides for the establishment of a standing committee to deal with the issues raised by the Convention.

The convention also includes measures in family law litigation. The court or any person appointed to represent a child has certain duties to facilitate the exercise of children's rights. The children should be able to assert their rights (e.g. to receive information and to express their opinion) personally or with the help of other people or bodies.

Proceedings under family law that deal with the special interests of children relate to custody, determining the whereabouts of children, visiting rights, establishing and contesting parentage, declarations of marital status, adoption, guardianship, asset management of children, and educational measures , the withdrawal or limitation of parental care, the protection of children from cruel and degrading treatment and medical care.

Each Contracting Party is required to identify at least three categories of family law proceedings to which the Convention is to apply. This European legal instrument is also intended to facilitate the implementation of the United Nations Convention on the Rights of the Child.
