European insolvency register

The European insolvency register is an internet portal of the European Union and an association of national insolvency registers (hence also: association of insolvency registers ). The European insolvency register is therefore not a central, uniform EU insolvency register, but a standardized access to the national insolvency registers.

Since July 7, 2014, the European insolvency register has been linked to the insolvency registers of seven EU member states (with Germany , Estonia , the Netherlands , Austria , Romania , Slovenia and the Czech Republic ) via the European Justice Portal as part of the pilot project . This enables a multilingual search query in all networked registers. The national insolvency registers in the EU member states will continue to be looked after and managed by them in accordance with their national law.

Background and goals

The national insolvency registers are an important source of legal information for interested or affected persons. The central request and query option is intended to simplify access z. B. be made possible for banks, creditors, business partners and consumers through bankruptcies. This is also intended to increase transparency and legal certainty on the European Union's internal market.

The data are provided centrally by the seven EU member states currently participating via the European e-Justice Portal. It is planned to extend this first step towards networking the insolvency registers to all EU member states and the EEA . This is also part of the initiative to modernize European insolvency law.

The European Insolvency Register is available in 23 official languages and is managed by the European Commission . You can enter search terms in the 23 official EU languages; the display is usually in the language of the EU member state in which the relevant insolvency proceedings are pending (no automatic or default translation through the portal).

The European Insolvency Register enables simple searches for the name of the debtor in the insolvency registers of the participating member states.

With the advanced search, different search criteria can be defined depending on the possibility of the national basic database of the individual Union member states. The various search operands that the national insolvency registers permit or specify (e.g. which special characters are permitted) must be taken into account .

To avoid misuse, a confirmation code is required for each search. The search results are displayed in alphabetical order and can also be sorted by country.
