Specialist lawyer for public procurement law

The specialist lawyer for public procurement law was decided by the 5th constitutional meeting of the Federal Bar Association on March 16, 2015 as the 22nd specialist lawyer .

Lawyers can acquire this additional qualification if they have completed a corresponding specialist lawyer course of at least 120 hours and passed three exams to prove their theoretical knowledge. According to § 14 o Fachanwaltsordnung (FAO), the specialist lawyer course must convey the following theoretical knowledge:

1. European and German regulations on public procurement , in particular

a) EU public procurement directives including the respective legal remedies directives ,
b) Law against Restraints of Competition (GWB),
c) Procurement Ordinance (VgV),
d) Basics of the procurement laws of the individual federal states and (if available) of the federal government,

2. Special features of the individual award procedures for:

a) Allocation of construction work according to VOB / A ,
b) Award of services according to VOL / A ,
c) Awarding of freelance services according to the VOF ,
d) Awarding of contracts in the field of transport, drinking water supply and energy supply according to the SektVO ,
e) Awarding contracts in the field of defense and security according to the VSVgV ,

3. Special features of procedure and litigation:

a) primary legal protection through review and appeal proceedings,
b) Main features of the procurement procedures before the ECJ ,
c) other legal protection before civil and administrative courts in connection with procurement procedures,

4. Procurement law aspects of state aid law ,

5. Main features of public pricing law.

The practical knowledge must be according to § 5 paragraph 1 lit. v Fachanwaltsordnung (Fachanwaltsordnung) can be proven through 40 processed cases, of which at least five are judicial or review proceedings.
