Professional entrepreneur declaration

A document in which a company confirms after completion that the services performed comply with the necessary regulations (laws, ordinances, DIN standards, guidelines) is referred to as a specialist contractor's declaration . The term is often used in the construction industry .

This must be distinguished from the specialist contractor's certificate, which is issued to the client in the course of the offer phase and thus before the performance of the service. With this, the company is supposed to prove the technical knowledge and efficiency.

According to VOB / A "§ 16b suitability" the client must check the suitability of the bidders. For this purpose, he can request proof of their suitability from the bidder in the award procedure (possess the necessary specialist knowledge, performance and reliability and have sufficient technical and economic resources) (cf. VOB / A "§ 15 Clarification of the content of the offer", Paragraph 3).

Also according to the model building regulation "§ 55 Entrepreneur", which can be found in many state building regulations, the entrepreneur involved in the construction is obliged, at the request of the building supervisory authority, for work in which the safety of the system depends to an exceptional extent on the special expertise and experience, its suitability to prove.
