Family council

As the remainder of the old clan guardianship, the family council was an institute in the guardianship system borrowed from the French family law of the Civil Code (Conseil de famille, §§ 405 ff) . Under the chairmanship of the local justice of the peace, it was specially composed and convened in individual guardianship matters and had to protect the interests of the ward .

The Prussian Guardianship Code of 1875 was adopted by the institute in the event that the father or mother ordered the meeting or three relatives or by- laws or guardians and counter- guardians requested it. The number of members ranged from two to a maximum of six. The institute was also included in the Civil Code (Sections 1858 - 1881 old version), where it had the rights and obligations of the Guardianship Court and existed until 1979.

In German princely law , the family council was convened by the head of the princely house if a family member had committed a criminal offense about which the head of the family had to decide according to the house laws.
