from Wikipedia, the free encyclopedia

The Franz von Zeiller Moot Court from Civil Law ( Moot Court Civil Law for short ) is a competition for students from all legal faculties in Austria , which has been held annually since 2003. The Moot Court is named after the Austrian lawyer Franz von Zeiller and co-founded by ELSA ( European Law Students' Association ). The federal final is preceded by an internal university preliminary round.

In the moot court, students take on the role of the party representatives in a simulated third-instance procedure over a civil law case. On the basis of the pleadings and pleadings, a senate decides on the legal remedies and, regardless of which university team, has best represented its client. The Senate consists of a Councilor of the Supreme Court , a university professor of civil law and a lawyer.

The proceedings are based on real second-instance decisions that have been appealed to the Supreme Court . The decision of the real Supreme Court will only come after the Moot Court is over .

The civil law moot court is regarded as the cadre forge of Austria's legal elite.
