With the law on the temporary, crisis-related improvement of the regulations for short-time work allowance , the German Bundestag authorized the federal government to change the legal regulations applicable to short-time work . This is intended to mitigate the economic consequences of the COVID-19 pandemic in Germany .

For this purpose, the relevant statutory authorizations have been included in the Third Book of the Social Code - Employment Promotion - and the Temporary Employment Act . The Federal Government can thus issue ordinances that temporarily facilitate access to short-time allowance and allow temporary workers to receive short-time allowance. On this basis, the ordinance on the facilitation of short-time work (short-time work allowance) was issued on March 25, 2020 ( Federal Law Gazette I p. 595 ).

The authorizations are limited to December 31, 2021.

Legislative process

The law on the temporary, crisis-related improvement of the regulations for short-time working allowance was passed in three readings by the German Bundestag and finally discussed by the Bundesrat within one day. The law from the government draft of March 12, 2020 could therefore come into force on March 15, 2020. According to experts, the legislative procedure proved that a “functioning parliamentary democracy” can react quickly to major challenges.
