Franz Josef Düwell

Franz Josef Düwell (born October 28, 1946 in Dortmund ) is a German lawyer , presiding judge a. D. at the Federal Labor Court and honorary professor at the University of Konstanz .

Studied law, history and political science from 1968 to 1974. After completing a law degree at the Westfälische Wilhelms-Universität Münster, during which he worked as a student editor for the Semesterspiegel in 1971 , and after passing the second state examination in May 1977, he entered the judicial service of the labor jurisdiction of the state of North Rhine-Westphalia . There he was initially employed at the labor courts in Bielefeld, Gelsenkirchen, Herne and Dortmund, and from 1989 onwards in the appeal instance at the regional labor court in Hamm.

Act

From 1985 to 1989 he was a research assistant at the Federal Labor Court (BAG). In March 1991, the state government appointed him presiding judge at the state labor court and the presidium of the state labor court Hamm assigned him the chairmanship of the second chamber of the state labor court Hamm. After just two years, Düwell was elected federal judge and on May 19, 1993, Federal President Richard von Weizsäcker was appointed judge at the Federal Labor Court. Johannes Rau appointed him presiding judge at the Federal Labor Court on August 17, 2001 and, following the decision of the Presidium of the Federal Labor Court, he chaired the Ninth Senate from September 2001 until retirement on October 31, 2011. From 1999 to 2010, in addition to his judicial work, he was the judicial officer for documentation and data processing at the Federal Labor Court. He was also a representative of the federal government on the advisory board of juris GmbH. Since 2008 advisory board member of the journal “Fachanwalt Arbeitsrecht” (FA), since 2014 advisory board member of the journal “Recht und Praxis der Rehabilitation” (RP Reha).

Düwell has been an honorary professor in the law department for labor law, data protection law and social law since 2010. He has also published a number of times in these areas of law. He is the editor or co-author of numerous comments. and author of seminal articles in specialist journals. Düwell is co-editor of the juris practice report labor law (jurisPR-ArbR) with weekly comments on the most important current decisions and legal innovations on labor law. He is an expert u. a. for the German Bundestag and regional parliaments. Other activities: Chair in works constitution law and employee representation law arbitration bodies as well as mediators u. a. in labor disputes.

Düwell has been President of the Arnold Freymuth Society for Contemporary Legal History since 1992 . He has also been a board member since 2007 and chairman of the non-profit German-Japanese Society for Labor Law (DJGA) since 2016, which promotes academic exchange between Japanese and German experts in labor law.

Awards (selection)

Visiting professor 2007 at Chuo University Tokyo. Awarded the honorary professorship by the Law Faculty at the University of Konstanz in 2010. Awarded the Cross of Merit on Ribbon of the Order of Merit of the Federal Republic of Germany (2017).
