Green electricity privilege

The term green electricity privilege in Germany colloquially describes the legal regulation for the partial or complete exemption of the electricity supply companies from paying the EEG surcharge , if they meet certain requirements. The green electricity privilege was valid until the EEG 2014 came into force on August 1, 2014.

In addition to the market premium introduced in 2012, the green electricity privilege was a major economic motivation for the direct marketing of EEG-compatible electricity.

According to section 39 (1) sentence 1 EEG 2012, electricity supply companies (electricity traders) were partially or fully exempted from paying the EEG surcharge to the transmission system operator if, based on the total amount of electricity they supplied, they had at least 50% EEG-capable electricity Systems within the meaning of Sections 23 to 33 EEG 2012 (all renewable energies ) and at the same time at least 20% electricity from EEG-compatible systems within the meaning of Sections 29 to 33 EEG ( wind energy and solar energy ) delivered directly to end consumers

The electricity from the EEG-compatible system operators was sold directly to the relevant trader (direct marketing in accordance with Sections 33a to 33i EEG 2012) and the system operator waived the guaranteed remuneration. In addition, according to Section 39 (2) EEG 2012 , the electricity supply companies had to notify their responsible transmission system operator of the use of the reduction by September 30 of the previous year.

Until the end of 2011 (according to Section 37 of the EEG 2009), the exemption was exactly the same as the EEG surcharge (in 2011: 3.530 cents / kWh). According to the EEG 2012, the exemption from 2012 was 2 ct / kWh, but at most the amount of the EEG surcharge (i.e. less than 2 ct / kWh if the annual EEG surcharge was below 2 ct / kWh).

While it actually played no role under the EEG 2004, the importance of the green electricity privilege has grown since the EEG 2009 came into force:

In November 2013, the grand coalition of CDU / CSU and SPD agreed to remove the green electricity privilege.
