Hague Minor Protection Convention

The Hague Convention for the Protection of Minors, MSA , officially in the Federal Republic of Germany: Convention on the Competence of Authorities and Applicable Law in the Field of the Protection of Minors , of October 5, 1961, is an international treaty on the competence for protective measures regarding minors and the law applicable to them . A total of 13 states belong to the agreement, at least in part; in addition to twelve European states, including Turkey, it is still considered a former colony of Portugal in the Chinese special administrative region of Macao.

In the 1960s France, Italy, the Kingdom of the Netherlands, Luxembourg, Switzerland, Austria, Portugal and Germany signed the treaty, which was written in French. While it was still effective in some states in the 1960s, ratification in Germany and Austria lasted until the 1970s (in Germany on September 17, 1971, see Federal Law Gazette 1971 II 219 and 1150; in Austria 1975) and in Italy until 1995. Spain joined in the 1980s, followed by Turkey, Latvia, Lithuania and Poland. By February 2009, not all contracting parties had agreed to their accession in accordance with Art. 15 c Vienna Convention on the Law of Treaties , so that the agreement has not yet come into full force for them.

Today, in particular, the jurisdiction regulations in the states of the European Union through the so-called Brussels IIa Regulation ( Regulation [EC] No. 2201/2003 of November 27, 2003 on the jurisdiction and the recognition and enforcement of decisions in matrimonial matters and in proceedings) regarding parental responsibility [OJ EU L 338 of December 23, 2003]).

The Hague Convention on the Protection of Minors (MSA) came into effect on January 1, 2011 in the Federal Republic of Germany through the Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in the Field of Parental Responsibility and Measures for the Protection of Children , in short: Hague Convention on the Protection of Children (KSÜ), has been replaced. The Federal Republic of Germany ratified the KSÜ on September 17, 2010.
