Hamburg storage conditions

The Hamburg Storage Conditions (HLB) are non-binding recommendations for general terms and conditions of the Hamburger Lagerhalter eV and the Hamburgischer Quartiersfolk Association of 1886 eV

Since the Commercial Code does not provide for any exclusions or limitations of liability, the HLB is often used in the warehouse business .

Limits of Liability

The reimbursable value of the goods is the common value. As far as the warehouse keeper is liable, the amount of the compensation to be paid by him is limited to two units of account for each kilogram of the gross weight of the goods. This liability limit corresponds to the lower limit of the liability corridor of freight law.

The warehouse keeper is not liable for indirect damage caused to the goods themselves, in particular lost profit.

Breach of liability

The exclusions and limits of liability do not apply if the warehouse keeper or one of his vicarious agents willfully or recklessly and in the knowledge that damage is likely to occur. The burden of proof lies with the depositor.
