Warehouse keeper

The warehouse keeper is a businessman who professionally takes on the storage and safekeeping of goods that are suitable for storage ( Section 467 HGB ). The warehouse keeper takes over the commercial storage and safekeeping of goods.

The storekeeper

  • receives the agreed remuneration for storage ( Section 467 Paragraph 2, Section 474 HGB),
  • has to acknowledge the acceptance of the goods to be stored,
  • must store the goods with the care of a prudent businessman ( Section 347 HGB) ( Section 475 (1) sentence 1 HGB),
  • has a statutory lien on the stored goods ( Section 475b HGB),
  • is liable for loss of or damage to the stored goods during the custody period (and in some cases also for further financial losses resulting directly from this ), § 475 HGB.

Regardless of the size of the business, the rules of commercial transactions apply to the warehouse keeper, but with certain exceptions.
