The ordinance on minimum structural requirements for old people's homes, retirement homes and nursing homes for adults (Heimmindestbauverordnung - HeimMindBauV) defines minimum structural requirements for homes within the meaning of the Home Act .

Since the home law was transferred to the federal states with the federalism reform, the regulation only applies in the federal states that have expressly declared the regulation to continue to be applicable (e.g. Free Hanseatic City of Bremen).

The main regulations include:

  • Homes must be barrier-free and, if necessary, have an elevator (§§ 3, 4)
  • Corridors and stairwells must be illuminated at night; Every room must have a socket for connecting a lamp (e.g. reading lamp) (§ 6)
  • Every room must have an emergency call system (§ 7)
  • Every home must have a patient telephone (§ 8)
  • In the event of an emergency (e.g. in the event of a fire), all rooms and toilets must also be accessible from the outside in order to ensure a second escape route (Section 9)
  • Bathtubs and showers must have privacy screens, communal facilities without privacy screens are not permitted (Section 10)
  • The home must have heating (§ 12)
  • Each room must be at least 12 m². Multiple occupancy is permitted, but rooms larger than four-bed rooms are generally not permitted (§§ 14, 19, 23)

In the case of dormitories for people with mental or intellectual disabilities , the requirements of the ordinance may be deviated from under certain circumstances due to the special needs of the residents (Section 29).

According to § 32 HeimMindBauV, the operation of a specified defective facility constitutes an administrative offense.
