Bankruptcy Avoidance

As insolvency dispute is referred to an institute of bankruptcy law , which is part of many legal systems. The challenge enables insolvency administrators to reverse asset shifts that the debtor undertakes in the run-up to the insolvency proceedings as part of such proceedings. This protects the insolvency debtor's assets , known as insolvency assets, which are distributed to all of the creditors as part of the proceedings , from being reduced.

Germany

In Germany, the avoidance of insolvency is regulated in Sections 129–144 of the Insolvency Code.

Austria

In Austrian insolvency law , the challenge is regulated in §§ 27–43 of the Insolvency Code (IO).
