Intercantonal agreement on the harmonization of construction terms

The Intercantonal Agreement on the Harmonization of Building Terms (IVHB) is a concordat between cantons in Switzerland that standardizes building terms and measurement methods. The harmonization is intended to simplify building and planning law for the Swiss economy and population.

Starting position

The building lease is regulated in Switzerland, both cantonal and municipal. There are over 140,000 articles of law and regulation in construction and planning. Until then, the building height had been defined differently 26 times. In order to put an end to this confusion of regulations, the Swiss Construction, Planning and Environment Directors' Conference (BPUK) launched the IVHB in 2005. This came into force on the occasion of the founding meeting on November 26, 2010. The “Intercantonal Body on the Harmonization of Building Terms” (IOHB) is responsible for the implementation of the IVHB. The IOHB consists of the Concordat Cantons, which are also members of the BPUK.

Construction terms

The Concordat uniformly describes 30 formal construction terms and methods of measurement, including:

  • Terrain (authoritative terrain)
  • Buildings (buildings, small buildings, extensions, underground structures, sub-level structures)
  • Building parts (facade alignment, facade line, projected facade line, protruding building parts, recessed building parts)
  • Terms of length, length dimensions (building length, building width)
  • Height terms, height dimensions (total height, facade height, knee height, clear height)
  • Storeys (full storeys, basement storeys, attic storeys, attic storeys)
  • Distances and distance ranges (limit distance, building distance, building lines, building area)
  • Usage figures (eligible property area, floor area figure, building mass figure, development figure, green space figure)

Only formal harmonization takes place through the IVHB: Terms and measurement methods are defined, but without specifying the exact dimensions. For example, the question of how high a house is actually built will be determined by the cantons and municipalities themselves in the future. The corresponding rules of the IVHB do not apply directly, but must be implemented by the acceding cantons into cantonal or communal law.

Accessions

The following cantons joined the Concordat by 2015: AG, BE, BL, FR, GR, LU, NE, NW, OW, SH, SO, SZ, TG, UR, ZG.

In 2015, the Zurich Cantonal Parliament refused to join the Concordat.

Federal Building Harmonization Act

Parliamentarians from different parties are pushing for a federal building harmonization law. With such a federal regulation, the cantons would have to accept an interference with their traditional constitutional competence, building law. The enactment of a federal building harmonization law would require a constitutional amendment.
