Class fund

The money quota of a school class is called the class fund . It arises, among other things, from regular (e.g. monthly) contributions from students or parents, but also from surpluses from cost contributions already paid (e.g. for school trips) and other income (e.g. sales activities).

A class treasury , which is not compulsory, is administered by the class teacher or a treasurer chosen by the community . If available, the money can be used to buy teaching materials, to redesign the classroom and to finance school excursions.

In some game shows for children, school classes compete against each other on television. Prizes can then be money for the class fund.

Difficulties can arise if individual students or parents do not want to participate in the class fund. There is basically no obligation to participate. Unless expressly agreed on the class fund, the answer to disputes often depends on the interpretation of the will of the parents and the principles of common law. A repayment claim should be problematic if you leave the class early. Some class teachers refuse to run a class fund because there is no public law basis for it and the teacher can be forced to justify himself because of his special position of power. In this case, a member of the parenting group can manage the class fund, but is then also responsible and accountable for the amounts of money received.

If one assumes the application of the law of the BGB-Gesellschaft for clear purposes, one encounters the difficulty that the deposited money can then only be disposed of unanimously. Whether a civil law company or an order exists should be decided on a case-by-case basis. As a rule, it can be assumed that the will of parents is such that smaller amounts can be used without the consent of all parents. However, decisions about large amounts or the class fund as a whole should be decided at a meeting. In the case of foreseeable major difficulties, one should consider dissolving the class fund and repaying the contributions or, in the general agreement, reimbursing one parent's contributions. Embezzling the money is a criminal offense.
