Local family policy

In the Federal Republic of Germany, communal family policy is understood to be family policy measures of a commune (or municipality ) that further develop family policy requirements at federal and state level.

Article 6 of the Basic Law of the Federal Republic of Germany obliges the federal government, states and municipalities to place the family under the special protection of the state. Article 28 (2) of the Basic Law gives municipalities the right to regulate their affairs on their own responsibility within the prescribed legal framework ( local self-government ). In an expertise for the North Rhine-Westphalian state parliament, the municipal level is described as the most direct and therefore the most suitable level of the state for family policy.

Possible goals of local family policy

Families are an important target group for local politics and administration . One goal of local family policy is to improve the immediate living environment for families. For example, municipalities have an interest in creating attractive living conditions for families so that they do not move away - for example after the birth of children - which would mean disadvantages in the intergenerational relationship and possibly a loss of tax revenues. Local family policy can be justified by the fact that the decision for or against starting or moving a family is based on local circumstances. It is also important to empower families to perform their tasks (upbringing, education, mutual help).

Possible tasks of local family policy

Municipalities fulfill family policy tasks because they have been entrusted to them by government agencies (e.g. child and youth welfare, social assistance, municipal services according to SGB II) and because they are obliged to do so in the course of self-administration (kindergarten places, educational advice). In addition, you can also voluntarily take the initiative. Voluntary services can be of a material nature (e.g. family-friendly fees, discounts) or immaterial offers (e.g. short-term care, provision of play mobiles for children). So-called strategic instruments of family policy for municipalities are, for example, municipal family reports or family-friendliness tests or certificates.

An expert opinion by constitutional lawyer Rüdiger Zuck , commissioned by the umbrella association Kind eV , showed that families who live outside of the supervising municipality should not be disadvantaged in the allocation of childcare places.
