Cost cancellation

Under cost cancellation is in German procedural law , the costs of the Basic Decision (z. B. with the wording "The cost of the dispute are ordered to") understood after each party their own expenses and legal costs depending bears half. This decision is possible if both parties in the legal dispute are partly defeated and partly won ( Section 92 (1) sentence 1 case 1 ZPO ). Alternatively, the costs can also be divided in a certain ratio (“Of the costs of the legal dispute, the plaintiff bears 1/3 and the defendant 2/3”).

In Swiss procedural law , one speaks of competing party costs .
