The district court of Gera was a district court in the GDR from 1952 to 1993 (and for a transitional period also in the new federal states) with its seat in Gera .

prehistory

In the Soviet Zone, the organization of the courts was established with the SMAD Order No. 49 of September 4, 1945. The courts that had existed on January 30, 1933 were to be restored. The Control Council Act No. 4 of October 30, 1945 confirmed this regulation.

In Gera there was the regional court of Gera and the district court of Gera . The higher regional court in Jena was relocated to Gera on August 7, 1945, which meant that courts of all three instances existed in Gera for several years. Since the higher regional court moved into the building of the regional court, this moved to the upper floors of the district court building. In 1950 the higher regional court was relocated to Erfurt. The judiciary was brought into line immediately after the war .

The district court

With the GDR Judicial Constitution Act of 1952, the previous courts were abolished and replaced by district and district courts. The Gera District Court was established in Gera . These included a district court in Gera-Land (initially in the building of the district court, the former district court building, then also in Clara-Zetkin-Strasse 11) and three district courts in Gera-Stadt (north: in the villa of the OHG Walther, Bach & Co. , Middle: in Clara-Zetkin-Straße 11, south: in Gutshof Zwötzen). After a short time, a joint district court Gera-Stadt was created at Clara-Zetkin-Straße 11.

Compared with the local courts, the district court had lost some of its competencies, particularly in the area of ​​voluntary jurisdiction. See GDR justice .

Roland Jahn was sentenced in January 1983 by the Gera District Court to 22 months' imprisonment for "publicly degrading the state order" and "disregarding state symbols", but was released after international protests and reports in the German media.

With the Thuringian Jurisdiction Law of August 16, 1993, the district court was dissolved and the district court of Gera was re-established.

The district court building

The district court had been assigned the Villa Münch / Ferber at Clara-Zetkin-Strasse 11 as the courthouse. The villa was built in 1865/67 by the architect W. Haupt and is now a listed building . The district court used the house throughout its history. Only when the district court was re-established did it move back into the traditional district court building in November 1997.
