District court Gera

The District Court of Gera is a German court of ordinary jurisdiction based in Gera Thuringia .

history

1879 to 1952

In Gera in the principality consisted Principality of Reuss-Gera , the District Court Gera and two judicial offices (Gera I and II) . As part of the introduction of the Reich Justice Laws , the Gera District Court and the judicial offices were dissolved in 1879 and its tasks were transferred to the Gera District Court and the Gera and Hohenleuben District Courts .

The district court of Gera was now subordinate to the regional court of Gera and this to the higher regional court of Jena . With the formation of the state of Thuringia, the Thuringian district court districts were reorganized on October 1, 1923. However, the district court of Gera was not affected.

In the Soviet Zone, the organization of the courts was established with the SMAD Order No. 49 of September 4, 1945. The courts that had existed on January 30, 1933 were to be restored. The Control Council Act No. 4 of October 30, 1945 confirmed this regulation.

In Gera there was the regional court of Gera and the district court of Gera. The higher regional court in Jena was relocated to Gera on August 7, 1945, which meant that courts of all three instances existed in Gera for several years. Since the higher regional court moved into the building of the regional court, this moved to the upper floors of the district court building. In 1950 the higher regional court was relocated to Erfurt. The judiciary was brought into line immediately after the war .

With the GDR Judicial Constitution Act of 1952, the previous courts were abolished and replaced by district and district courts. The district court of Gera was established in Gera and the district court was repealed.

Since 1993

With the Thuringian Jurisdiction Law of August 16, 1993, the district court was dissolved and the district court of Gera was re-established.

In addition to the regular tasks of a local court, the Gera District Court is responsible for the following tasks and procedures:

  • Concentrated jurisdiction in the district of Gera for insolvency proceedings
  • Detention court for the district court districts Gera, Altenburg and Greiz

In 1936, the district court consisted of a director and eight district judges, three assessors, nine judicial officers, eleven judicial inspectors, four judicial chief secretaries, two office secretaries, four higher bailiffs, four law firm secretaries, one clerkship secretary, four court superintendent and a caretaker.

In 2007 there were 145 employees at the Gera District Court. These included 24 judges, 28 judicial officers, 74 civil servants in the middle judicial service, 10 judicial employees and 10 bailiffs

The district court had its seat in the so-called "country house" on Schloßstraße, at the place of today's district court building. On April 1, 1891, the Princely Reussian j. L. State Treasury from Geraer Bank Aktiengesellschaft bought the bank building at Schloßstraße 22 for 390,000 marks. This building has since been used as a district court building.

The district court had been assigned the Villa Münch / Ferber at Clara-Zetkin-Strasse 11 as the courthouse. Accordingly, the district court had its seat there from 1993 onwards until it returned to the historic district court building in November 1997.
