The predecessor of the Schmölln District Court was the “Schmölln Court Office”, which was formed as a lower administrative and judicial authority for the southeastern parts of the former Altenburg District Office in the eastern district when the sub-authorities in the Duchy of Saxony-Altenburg were reorganized in 1854 . In 1876 it lost its administrative tasks to the new administrative district of Schmölln . As a judicial authority, the Schmölln judicial office continued until the introduction of the Reich Court Constitution Act in 1879.

On the occasion of the introduction of the Courts Constitution Act on October 1, 1879, a district court was established in the city of Schmölln in the Duchy of Saxony-Altenburg, the district of which was formed from the district of the previous Schmölln court office. After the Free State of Saxony-Altenburg, which had only been founded two years earlier, had risen in the state of Thuringia in 1920 , the Schmölln District Court continued to operate as the Thuringian District Court from 1921. The superordinate instance was the Altenburg Regional Court until September 1, 1949 , then the Gera Regional Court .

Shortly before the administrative reform in the GDR in 1952, the Schmölln District Court was repealed and its entire district was assigned to the Altenburg District Court . With the abolition of the local courts in the GDR, the Schmölln District Court was created in 1952 .
