The state immediacy results from the Social Security Code and regulates the state supervision of the statutory insurance carriers .

For example, Section 90 SGB ​​IV stipulates that the supervision of insurance carriers whose area of ​​responsibility does not extend to more than three federal states is carried out by the highest administrative authorities of the states responsible for social security .

If the area of ​​responsibility extends beyond this (federal insurance carriers), the Federal Social Security Office is responsible for supervision. The BMAS is responsible for prevention in the statutory accident insurance and the BMF is responsible for the Accident Insurance Post and Telecom.
