Foliage rent

leaves

A leaf rent is defined as a claim due to an unusually severe impairment of a property due to leaf fall originating from another property .

According to German law, property owners can be expected to tolerate or remove leaves that are blowing onto their property from foreign trees. In principle, there is no entitlement to compensation for leaf fall.

Something else applies if the fall of leaves is customary in the area, but is of such a magnitude that it represents a significant impairment of the property in question beyond what is reasonable. In this case, the owner of the property causing the leaf fall has to pay the person concerned an annual amount of money, the leaf rent, in accordance with Section 906 (2) BGB . The amount of the leaf rent is determined by the amount that results from the increased cleaning effort.
