Deficiency subject decree

Deficiency Subject Decree is the slang term for a decree issued by the Ministry of Education in North Rhine-Westphalia , which until recently enabled teachers with a teaching qualification for urgently needed subjects to be civil servants up to the age of 45 . In contrast to practically all other German federal states , the maximum age limit for civil servants in North Rhine-Westphalia is only 35 years.

The decree was last reaffirmed on June 15, 2006 and its validity was extended until July 31, 2007. On June 23, 2006, however, the Ministry for Schools and Further Education of North Rhine-Westphalia suspended it nine months earlier with a new decree: It was to be used for the last time for the teachers selected in the tendering process and list process at the beginning of the 2006/07 school year. The ministry advertised the longer maximum age limit on its website until September 23.

Original enactment and renewals

By circular of December 22, 2000 - 121 - 22/03 No. 1050/00, the then Ministry for Schools, Youth and Children of the State of North Rhine-Westphalia permitted a general exception to the maximum age limit under career law. Teachers with a qualification to teach chemistry, physics, English, social sciences, home economics, technology, computer science, Protestant religious studies, art, music, mathematics, Latin and sport were able to enjoy it.

This decree was extended several times in subsequent decrees: on April 23, 2001 (file number 121-24 / 03 No. 297/01), on November 16, 2004 and for the last time on June 15, 2006 (file number 211-1.12.03.03- 973)

Withdrawal and Outlook

According to its own information, the decree was repealed by the MSW for cost reasons with the subsequent decree of June 23, 2006 at the end of the 2006/07 recruitment process.

In response to an oral question from the SPD parliamentary group in the plenary session of September 13, 2006, Minister Barbara Sommer announced that the subjects of social sciences, technology, Protestant religious studies, construction technology, textile and clothing technology were no longer inadequate subjects.

In North Rhine-Westphalia there are currently shortages in English, home economics, computer science, art, mathematics, physics and sport (secondary level I), computer science, art, mathematics and Latin (secondary level II) or mechanical engineering, electrical engineering, nutrition and home economics as well as social education (professional area ).

On November 7, 2006, the SPD's parliamentary group applied in vain to reinstate the repealed deficiency-specialist decree in order to prevent older applicants from migrating to other federal states.

Before the 2009 summer vacation, however, the state government of North Rhine-Westphalia raised the maximum age limit under career law to 40 years.
