The government of the Republic of Azerbaijan has been administered by the Cabinet of Ministers of the Republic of Azerbaijan (Azerbaijani: Azərbaycan Respublikası Nazirlər Kabineti - "Cabinet of Ministers of the Republic of Azerbaijan") since independence in 1991 .

The Cabinet of Ministers has had its seat in the government building of the Republic of Azerbaijan in the capital Baku since 1991, succeeding the Council of Ministers of the Azerbaijan SSR . Artur Rasizade has been Prime Minister of the Republic of Azerbaijan since 1996.

The President of the Republic of Azerbaijan forms the Cabinet of Ministers for the organization and exercise of executive powers . The Cabinet of Ministers is the higher executive body of the President of the Republic of Azerbaijan. It reports to the President and is accountable to him.

composition

In accordance with Article 115 of the Constitution of the Republic of Azerbaijan , the Cabinet of Ministers consists of the Prime Minister , his deputies and the ministers.

The Prime Minister is appointed by the President of the Republic of Azerbaijan with the consent of Parliament . As a rule, the Prime Minister chairs the meetings of the Cabinet of Ministers.

The president dismisses the prime minister. The President appoints and dismisses the members of the Cabinet of Ministers.

Competencies

The Cabinet of Ministers has the following competencies and tasks:

  • draws up the draft state budget of the Republic of Azerbaijan and submits it to the President of the Republic of Azerbaijan;
  • ensures the implementation of the state budget;
  • ensures the implementation of financial, credit and monetary policy;
  • ensures the implementation of state economic programs;
  • ensures the implementation of state social programs;
  • directs the ministries and other central executive bodies and suspends their acts;
  • decide on other issues that the President of the Republic of Azerbaijan has assigned to his jurisdiction.

Regulations

The working method of the Cabinet of Ministers of the Republic of Azerbaijan is regulated in the rules of procedure of the Cabinet of Ministers of the Republic of Azerbaijan. The rules of procedure of the Cabinet of Ministers are determined by the President.

Prime Minister's immunity

Article 123 of the Azerbaijani Constitution states that the Prime Minister has the right of immunity . The Prime Minister can be arrested if caught in the act. He may not be prosecuted with a court-imposed administrative penalty or subjected to a search or personal check.

At the request of the Prosecutor General of the Republic of Azerbaijan, the President decides on the waiver of immunity.
