Personnel deployment management is an instrument used primarily in public administration for target and cost-optimized personnel deployment .

The personnel that are no longer required due to a decision by the budget legislator (the so-called "overhang personnel") are identified in the authorities / departments. The number of employees no longer required is determined. The specific employees no longer required are specified by name using a defined procedure (“personalization”). The personalized employees are transferred to an authority that has taken on the management of the personnel deployment for the respective regional authority. If there is a need for staff at another authority , this must primarily be covered with the identified surplus staff. This means that personnel deployment management is an instrument for downsizing, as the surplus personnel is deployed in a targeted manner where there is a need for personnel. Without the personnel deployment management, recruiting / hiring of other employees would have to take place at these positions.

Development in the Federal Republic

In October 2003 the former state-owned company Deutsche Telekom AG founded its service company "Vivento". With the Job Pool Act of December 9, 2003, the Central Personnel Surplus Management ("ZeP") was founded in Berlin. With the law on the establishment of a personnel deployment management of June 15, 2007, a comparable institution was created with the state office for personnel deployment management in North Rhine-Westphalia.

criticism

The criticism of personnel deployment management, which has been expressed in some cases, is sparked by the restricted rights of participation of the staff councils and the question of the legality of the transfer of civil servants to the job pool. A prerequisite for a lawful transfer of an official is the simultaneous assignment of a specific, permanent and officially appropriate job. This legal claim is derived from the case law from Article 33 (5) of the Basic Law. The decision on this issue has been the subject of numerous legal proceedings. In the meantime, the Higher Administrative Court of Berlin-Brandenburg is questioning the compatibility of the Job Pool Act with higher-ranking law.
