Care allowance

The care allowance is in Germany a performance of the social compensation law and in § 35 BVG regulated. It is intended to ensure the care of those who have become injured in need of care and largely corresponds to the benefits of statutory long-term care insurance and care assistance within the framework of social assistance.

The prerequisite for the care allowance is that the damaged person has become helpless within the meaning of Section 33b (6) EStG; this corresponds to the criteria for the issue of the mark H in the severely handicapped pass . If the damage has caused brain damage and the damaged person has a degree of damage consequences of 100, there is an entitlement to care allowance, even if the damaged person is not helpless. The same applies to the blind; they are also to be classified at least in level III.

As a rule, care allowance is paid at level I, which corresponds to an amount of 293 euros. If permanent care or exceptional care is required due to the particular severity of the damage, the damaged person is instead classified in Levels II to VI, depending on the severity of the damage. The criteria are based on the Health Care Ordinance .

If the injured person employs a carer, the reasonable costs will be covered. If home care is necessary due to the severity of the damage, the home costs will be covered in full; all pension claims will be offset against this except for a deductible, which corresponds to the amount of the basic pension with a GdS of 100.

Nursing care allowance is not paid if the injured party is housed as an inpatient; any entitlement that has already arisen expires after one month (levels I-II) or twelve months (levels III-VI) in the case of inpatient accommodation.
