Plaumann decision
Plaumann & Co / Commission (1963), the decision on Case 25/62 is a judgment of the European Court of Justice regarding the requirements for an individual to annul a decision within the European Union .
background
Plaumann & Co is an importer of clementines . The German authorities have asked for the tariff on imports to be lifted, but the European Commission has rejected the request. Mr Plaumann is appealing the Commission's decision.
The European Court of Justice has ruled that Plaumann & Co had no active legitimation against the decision of the Commission, because it is not "individually affected".
