Qualified attempt

In criminal law , one speaks of a qualified attempt if an attempted offense still contains a completed offense.

Example: someone shoots another with the intention of killing him with an aimed shot at the head. The shot misses the head and only hits the ear of the targeted person. There is at least one attempted manslaughter according to § 212 , § 22 StGB . Furthermore, by hitting the ear, dangerous bodily harm according to § 223 , § 224 Paragraph 1 No. 2 Alt. 1 StGB has been implemented. The manslaughter has been attempted and the dangerous bodily harm has been accomplished, so it is a qualified attempt.

The qualified attempt should not be confused with the successfully qualified attempt or the attempt to qualify for success .
