Right to Housing

The right to housing is a so-called second generation human right . Its basis in international law is Article 11 of the International Covenant on Economic, Social and Cultural Rights (ICESCR), Article 16 of the European Social Charter of December 16, 1966 and Article 31 of the revised European Social Charter. The right to housing is also implicitly granted by the African Charter of Human Rights and the Rights of the Peoples . According to the UN Committee on Economic, Social and Cultural Rights , aspects of the right to housing under the ICESCR also include: legal protection of the workplace; the availability of services, materials, facilities and infrastructure; Affordability; Habitability; Accessibility, location and cultural appropriateness.

In Germany, in the summer of 1919 , the Weimar Constitution formulated for the first time in Art. 155 the state goal of ensuring "every German a healthy home".

The right to housing was formulated as a political goal by Franklin D. Roosevelt in his speech on the Second Bill of Rights in 1944 .

In the GDR the right to housing was enshrined in the constitution of April 6, 1968.

UN special envoy

The United Nations regularly appoints Special Rapporteurs on the Right to Housing. From 2014 to April 2020, Canadian human rights activist Leilani Farha was the UN Special Rapporteur on the Right to Adequate Housing .
