The Rechtsanwalts-Aktiengesellschaft is a service company for lawyers in the legal form of a stock corporation (AG).
The object of the Rechtsanwalts-Aktiengesellschaft is the handling of third-party legal matters, including legal advice by taking on patent attorney assignments, the execution of which is only carried out by authorized lawyers working for the company, independently and on their own responsibility, taking into account their professional law. For this purpose, the Rechtsanwalts-Aktiengesellschaft ensures the necessary personnel, material and spatial requirements.
Since the professional law of patent attorneys essentially corresponds to that of lawyers , this also applies accordingly to patent attorneys' stock corporation.
In several European countries (for example in Switzerland ) lawyers 'joint stock companies and patent lawyers' joint stock companies have long been common. In Germany , the Patentanwalts-Aktiengesellschaft was first recognized in 2004 and the Rechtsanwalts-Aktiengesellschaft was recognized by the highest court in 2005. The decision of the Federal Court of Justice (BGH) of January 10, 2005 by resolution of the Senate for Legal Matters ( Az AnwZ (B) 27/03) emphasizes the principle of freedom of occupation anchored in Article 12 of the Basic Law as a decisive assessment criterion.
According to the BGH decision, the legitimacy of Rechtsanwalts-Aktiengesellschaft is based directly on Article 12 of the Basic Law and therefore does not require any separate statutory regulation.
The legitimacy of patent attorney stock corporations was also recognized for the first time in 2004 with the entry of the first patent attorney corporation in the commercial register , based on Article 12 of the Basic Law and the general provisions of stock corporation law .
