A file number ( abbreviation Az. ) Is used to identify files with a signature (regardless of the medium).

In practice, major deviations from this technique are possible. In principle, files are only created for the lowest level of the file plan (“subject unit”) and only when required.

Volume numbers are appended with “Bd.” Or “-” ( divis ).

Some file numbers are less obvious to interpret; z. B. "20/1 - 1/21 - 1044" can only be interpreted by looking at the associated file plan.

In local government, the file numbers according to the KGSt sample file plan are used .

The general file decree has been in force in the area of ​​judicial administration since 1952. Thematic-numerical file number (§ 6 GenAktVfg; example: 1456 for the general file order itself, 1454 for the judicial file order), department number and distinguishing characters form the transaction number (§ 7 GenAktVfg).

A distinction must be made between file numbers and file numbers, such as B. for classified information (labels "NfD", "secret", "top secret").

Judiciary

The court file number is used to identify a document and goes back to the file order (AktO) of November 28, 1934 and its predecessors. This is continued today at the state level by the individual files regulations of the federal states, at the federal level for example by the AktOBGH. The judge responsible for a legal dispute results from the business distribution plan to be drawn up by the courts every calendar year . This is the legal judge according to Article 101, Paragraph 1, Clause 2 of the Basic Law.

The court file number usually consists of a department, register number, number and year (Section 4 (2) AktO). In principle, it is also the business number (also called the business reference); Only in land register matters is it supplemented by a serial number to form the transaction number (Section 4 (1) AktO).

In the district court procedure, for example, the file number 12 C 580/06 shows that, according to the business distribution plan of the district court, which anyone can see, a certain judge from Department 12 for general civil matters (= C) in the order of the serial number 580 of the calendar year 2006 has jurisdiction and that the lawsuit was received by the court in 2006.

Inaccuracies and possible violations of the aforementioned Article 101, Paragraph 1, Sentence 2 of the Basic Law can arise if complaints received at the end of the year, for example on December 22, 2006, are carried over to the following calendar year and are given file number 12 C 13/07 there. The two-digit year number 07 would mean that the lawsuit, which was received on December 22, 2006, was only subsequently received by the court in the 2007 calendar year.

Equally inaccurate is the transfer of Act 14 C 437/ 04 from a since 2004 pending legal proceedings in a subsequent calendar year, for example, 2007 under the registration number 12 (14) C 27/ 07 . This creates the impression for the public and the statistics that the lawsuit was only filed in 2007 and that backlogs have been dealt with, on the other hand that an additional boost to work is imminent for the 2007 calendar year.

The filing system with the regulation of the registration numbers supports the division of labor among the judges and, for those seeking justice, the constitutionally guaranteed right to the legal judge according to Article 101, Paragraph 1, Clause 2 of the Basic Law.

Register characters

The register number is the part of the file number that refers to a specific file register .
