File number (Germany)
A file number ( abbreviation Az. ) Is used to identify files with a signature (regardless of the medium).
Terminologically, a distinction must be made between administration (including administration of justice ) on the one hand and justice on the other.
administration
The file number of the public administration is systematically assigned on the basis of the file plan and the list of files kept therefrom and is noted on the document container together with the title of the file and listed in the file list. The file number is often associated with the business character confused for identification of a document, but is only a part of the subject mitumfassender shop sign, which in turn consists of organizational unit, reference and possibly an Operation / document attributes.
The file number is the unique identification of a file. It can consist of a combination of numbers and / or letters and must not be assigned twice. Any written material on the subject must be clearly assigned via the file number.
Essential components of a file number in Germany are the file plan number and a serial number; both are separated from each other by a slash ( solidus ).
Examples:
Filing plan identifier | Serial number | file number formed from it |
---|---|---|
7654 | 8th | 7654/8 |
211321 | 37 | 211321/37 |
211431 | 0 | 211431/0 |
The filing plan identifier can be supplemented by a derivation identifier, for example to make subdivisions according to federal states.
Example: 2200-BY / 14
"Special files" created to relieve the main files are designated with Roman numerals, which are placed after the serial number.
Example: 2200-BY / 14 III
In practice, major deviations from this technique are possible. In principle, files are only created for the lowest level of the file plan (“subject unit”) and only when required.
Volume numbers are appended with “Bd.” Or “-” ( divis ).
Some file numbers are less obvious to interpret; z. B. "20/1 - 1/21 - 1044" can only be interpreted by looking at the associated file plan.
In local government, the file numbers according to the KGSt sample file plan are used .
The general file decree has been in force in the area of judicial administration since 1952. Thematic-numerical file number (§ 6 GenAktVfg; example: 1456 for the general file order itself, 1454 for the judicial file order), department number and distinguishing characters form the transaction number (§ 7 GenAktVfg).
A distinction must be made between file numbers and file numbers, such as B. for classified information (labels "NfD", "secret", "top secret").
Judiciary
The court file number is used to identify a document and goes back to the file order (AktO) of November 28, 1934 and its predecessors. This is continued today at the state level by the individual files regulations of the federal states, at the federal level for example by the AktOBGH. The judge responsible for a legal dispute results from the business distribution plan to be drawn up by the courts every calendar year . This is the legal judge according to Article 101, Paragraph 1, Clause 2 of the Basic Law.
The court file number usually consists of a department, register number, number and year (Section 4 (2) AktO). In principle, it is also the business number (also called the business reference); Only in land register matters is it supplemented by a serial number to form the transaction number (Section 4 (1) AktO).
In the district court procedure, for example, the file number 12 C 580/06 shows that, according to the business distribution plan of the district court, which anyone can see, a certain judge from Department 12 for general civil matters (= C) in the order of the serial number 580 of the calendar year 2006 has jurisdiction and that the lawsuit was received by the court in 2006.
Inaccuracies and possible violations of the aforementioned Article 101, Paragraph 1, Sentence 2 of the Basic Law can arise if complaints received at the end of the year, for example on December 22, 2006, are carried over to the following calendar year and are given file number 12 C 13/07 there. The two-digit year number 07 would mean that the lawsuit, which was received on December 22, 2006, was only subsequently received by the court in the 2007 calendar year.
Equally inaccurate is the transfer of Act 14 C 437/ 04 from a since 2004 pending legal proceedings in a subsequent calendar year, for example, 2007 under the registration number 12 (14) C 27/ 07 . This creates the impression for the public and the statistics that the lawsuit was only filed in 2007 and that backlogs have been dealt with, on the other hand that an additional boost to work is imminent for the 2007 calendar year.
The filing system with the regulation of the registration numbers supports the division of labor among the judges and, for those seeking justice, the constitutionally guaranteed right to the legal judge according to Article 101, Paragraph 1, Clause 2 of the Basic Law.
Register characters
The register number is the part of the file number that refers to a specific file register . The courts responsible for appeals, for example, keep special registers of appeals or revisions in which only appeals or revisions are recorded. Now one of the places parties , for example an appeal, so when is office of the court awarded for this procedure a unique reference number, is evident from the result of the tab character in turn, that the file is to be sought in the appeal register.
The register number has a similar thematic function in the area of justice as the file number in the area of administration. A formal difference lies in the fact that the registration number consists of letters (or in the case of voluntary jurisdiction , Roman numerals), while the administrative file number is usually based on an Arabic-numerical designation according to the decimal system.
Examples
-
LG Musterstadt 34 O 13/04 as a typical file number of an ordinary court in civil proceedings.
- Regional Court of Musterstadt - 34th Chamber - Register for General Civil Matters 1st Instance - 13th case of the year 2004 . For better understanding, the slash between the consecutive number (13) and the year (04) is explicitly mentioned when making a dictation or telephone call , for example: “Thirteen dash zero four” or “thirteen out of zero four”.
- Here "O" is the so-called register symbol.
-
LG Musterstadt 22 Ks 34 Js 1213/04 as a typical file number of a regular court in criminal proceedings.
- In criminal cases, the file number of the public prosecutor's office is used and supplemented by the name of the court / chamber and the type of procedure:
- 22 Ks = 22. Large criminal chamber as jury court
- 34 Js = 34th department of the prosecuting prosecutor
- 1213/04 = 1213. Prosecutor's office of 2004
- In criminal cases, the file number of the public prosecutor's office is used and supplemented by the name of the court / chamber and the type of procedure:
- (In criminal cases, the file number does not indicate the year in which the proceedings became pending before the court, but only the year in which the case was received by the public prosecutor)
-
VIII ZR 350/03 of September 22, 2004 - decision of
- VIII. Civil Senate ( see court organization of the Federal Court of Justice )
- ZR = revisions in civil matters
- File number: 350/03, where (03) refers to the year in which it was brought in and (350) is a sequential number.
- The date, if indicated, refers to the time of the announcement.
-
1 StR 287/05 of December 7, 2005 - decision of
- 1. Criminal Senate ( see court organization of the Federal Court of Justice )
- StR = revisions in criminal matters
- File number: 287/05, where (05) refers to the year in which it was brought in and (287) is a sequential number.
