Shipping Court

A shipping court is a district court that decides in inland shipping matters. According to the law on judicial proceedings in inland shipping matters (BinSchGerG) , this includes civil litigation , criminal matters and fines , for example

  • Claims for damages from accidents, damage or unauthorized actions
  • Claims to mountain wages
  • Claims for payment of pilot, crane, weighing, port and screed fees
  • Criminal and fine matters, etc. a. due to the skipper being drunk or violating environmental protection regulations

For appeals and complaints, the higher regional court of the respective district court is responsible as the higher shipping court. The revision is not provided in criminal matters. In matters relating to the navigation of the Rhine in accordance with the Act on the Navigation of the Rhine , the Central Commission for the Navigation of the Rhine (CCNR) in Strasbourg can optionally be called upon as a court of appeal in addition to the Higher Courts for the Navigation of the Rhine ; in matters relating to the navigation of the Moselle, the appeal committee of the Moselle Commission in Trier.
