Attorney's Court

The Lawyers' Court in Germany complaint - and appellate instance (§§ 142, 143 BRAO) for decisions of the attorney court . In the first instance he is responsible for administrative law matters according to § 112a para. 1 BRAO and according to § 123 BRAO for requests from lawyers for court decisions.

The legal relationships of the law courts are regulated in Sections 100-105 of the Federal Lawyers' Act. According to these regulations, the Lawyers' Disciplinary Court is established as a professional court at the Higher Regional Court . If a federal state has several higher regional courts, the respective state government can also determine the establishment of just one legal court by ordinance . There is currently only one Lawyers' Disciplinary Court for each federal state. The lawyer's courts are staffed with professional judges from the higher regional courts and lawyers (§§ 101, Paragraph 1, Clause 1, 102, Paragraph 1 BRAO). The presidents and chairmen of the senate must be lawyers (Section 101 (1) sentence 2 BRAO).

The Senate for Legal Matters at the Federal Court of Justice is superordinate to the Higher Lawyers' Court . The predecessor was the Court of Honor for German Lawyers.
