Distribution procedure

A distribution procedure occurs in Germany by operation of law if an amount of money is deposited in the movable property in the event of foreclosure that is insufficient to fully satisfy the creditors involved ( §§ 872 ff. ZPO ). The reason for the deposit of such funds is usually that several seizure and transfer orders have been issued and the third party debtor is not sure to which seizure creditor he has to pay.

The district court, as the enforcement court, calls on the creditors to submit a claim calculation, draws up a division plan and sets a date for explaining the division plan and executing the distribution.

The division plan will be carried out if it is not contradicted in the appointment . A contradicting creditor must prove within one month that he has filed an objection claim . Otherwise, the division plan will be carried out despite the contradiction.
