Criminal senate
As criminal panels which are under German law Chamber for criminal cases at the higher regional courts ( § 116 GVG ) and the Federal Court of Justice ( § 130 , § 132 GVG) refers.
Until the abolition of the Bavarian Supreme Court this was also there for the Chamber, which decided in the criminal proceedings ( jump revisions , first instance OLG jurisdiction revisions to appeal judgments of district courts ).
The criminal panels at the Higher Regional Court usually decide as a panel with three professional judges . Only in criminal cases of first instance do they decide on the opening of the main proceedings with five professional judges. At the same time, it is decided whether the main hearing - depending on the scope and difficulty of the matter - will be conducted with three or five professional judges ( Section 122 of the GVG).
The criminal panels at the Federal Court of Justice are usually made up of five professional judges. In the case of certain complaints and applications, they decide with three professional judges ( § 139 GVG).
At the Federal Court of Justice there are six criminal senates as well as the large senate for criminal matters, which is responsible for those cases in which one criminal senate wishes to deviate from the opinion of another criminal senate .
The 1st , 2nd , 3rd and 4th criminal senate are located at the headquarters of the Federal Court of Justice in Karlsruhe . The 5th and 6th Criminal Senate are based in Leipzig in the Villa Sack .
