XIII. Civil Senate of the Federal Court of Justice

The XIII. The civil senate is a newly formed panel of the Federal Court of Justice with effect from September 1, 2019 . It is one of a total of thirteen senates currently dealing with civil matters.

Jurisdiction

The XIII. With its establishment, the Civil Senate has assumed the following responsibilities:

  • for legal complaints according to § 70 FamFG in cases of deprivation of liberty from the 5th civil senate (business distribution plan 2019 5th civil senate no.2a),
  • for legal disputes about claims from purchase and exchange that relate to the Renewable Energy Sources Act (EEG) or the Combined Heat and Power Act (KWKG), from the VIII Civil Senate (sub-area from Business Distribution Plan 2019 VIII Civil Senate No. 1a),
  • for legal disputes about procurement procedures by public contracting authorities, including decisions in submission procedures in accordance with Section 179 (2) GWB of the X Civil Senate (GVP 2019 X Civil Senate No. 10).

The Senate was based on the provision of budget funds on the basis of an initiative of the Budget Committee of the German Bundestag in the 2019 budget, with which funds were also approved for a further criminal senate in Leipzig, through the implementation required under Section 130 (1) sentence 2 of the Courts Constitution Act Established by organizational decision (administrative order) of the Federal Ministry of Justice and Consumer Protection from August 20, 2019 to September 1, 2019.
