XII. Civil Senate of the Federal Court of Justice

The XII. The civil senate is a panel of the Federal Court of Justice . It is one of a total of 13 senates currently dealing with civil matters.

He is mainly responsible for family law and commercial tenancy law.

  2. the decisions in placement matters according to § 312 FamFG;
  3. determining the competent court in accordance with Section 36 (3) ZPO in family disputes and matrimonial matters;
  4. the recognition and declaration of enforceability of foreign decisions in the field of family law;
  5. the litigation over
    1. Rental and leasing relationships, unless III. Civil Senate (No. 9 allotment garden leases ), the V Civil Senate (No. 1 k land lease ), the VI. Civil Senate (No. 5 a Maritime and Inland Shipping Matters ) or the 8th Civil Senate (No. 1 d and 2 Housing Rental, Leasing ) is responsible,
    2. Lending and safekeeping, unless III. Civil Senate (No. 3 c custody under public law ), the V Civil Senate (No. 1 a Contracts on Land ) or the XI. Civil Senate (No. 1 c Stock Exchange Law ) is responsible.

history

The Senate, which was initially called the IVb Senate and was given its current name at the beginning of 1990, emerged from the division of the IV Civil Senate (originally responsible for family and inheritance law).
