Claudio Nedden-Boeger

Claudio Nedden-Boeger (born January 13, 1966 in Essen ) is a German lawyer and judge at the Federal Court of Justice .

Life

After completing his doctorate and legal clerkship , Nedden-Boeger began his legal career in North Rhine-Westphalia in 1995 . During his probationary period, he was employed at the regional court in Bochum and at the district court in Recklinghausen as well as as part of a secondment in the IT department of the higher regional court in Hamm . At the beginning of 1999 he was appointed judge at the Essen Regional Court. From there, Nedden-Boeger was seconded to the North Rhine-Westphalian Ministry of Justice from 2002 to 2004 . This was followed by a secondment to the Hamm Higher Regional Court and finally, in October, he was appointed judge at the Higher Regional Court. Here he was responsible for insurance matters and most recently in the 11th Family Senate for family matters. On January 3, 2011, he was appointed judge at the Federal Court of Justice and assigned to the II. Civil Senate , now he is a member of the XII. Civil Senate . He has been a member of the Constitutional Court for the State of North Rhine-Westphalia since 2012 , for which he was re-elected in 2018.

Nedden-Boeger is married and has two children. Until May 2011 he was chairman of the presbytery of the Paulus community in Essen-Heisingen .

Nedden-Boeger is a member of the Bündnis90 / Die Grünen party (Essen district association).

In the course of the Edathy affair , he expressed doubts as to whether the investigation against Sebastian Edathy had been legitimate at all. So be u. a. the initial suspicion was only based on an "abstract typology of perpetrators", which is not sufficient. The immunity serves "only the ability of parliament to work and thus nothing less than democracy itself." According to Nedden-Boeger, the Edathy case could give the authorities clearer guidelines for preliminary investigations against persons who were "for the sake of democracy" enjoyed political immunity.

As part of the discussion as to whether the criminalization of so-called fare evasion would be useful, he suggested that those in need by the state in their environment for them free public transport should be opened -Fahrtmöglichkeit. He wanted to equate Hartz IV recipients with severely disabled people. This should make it possible for the 46% who have not previously paid for travel to be able to use public transport “without falling into the criminal liability trap”.
