VIII. Civil Senate of the Federal Court of Justice

The 8th Civil Senate is a judging body of the Federal Court of Justice . It is one of a total of thirteen senates currently dealing with civil matters.

He is mainly responsible for sales law and residential tenancy law.

Jurisdiction

According to the BGH's business distribution plan (as of 2015), the 8th Civil Senate (practically unchanged since 2012) is responsible for:

  1. the litigation over
    1. Claims from the purchase and exchange of movable property and rights, unless the V Civil Senate (No. 1 d, No. 3), the IX. Civil Senate (No. 6 a) or the XI. Civil Senate (No. 1 a) is responsible,
    2. Claims from the acquisition of a commercial transaction (Section 95 (1) No. 4 d GVG),
    3. Claims arising from possession and ownership of movable objects, insofar as ownership has been reserved or transferred as security in connection with contracts for the purchase or exchange of movable objects or rights,
    4. Leasing ;
  2. the decisions in legal disputes about residential leases, including legal disputes about the tenant's right of first refusal according to § 577 BGB.

The jurisdiction for legal disputes over claims from purchase and exchange, which concern the Renewable Energy Sources Act (EEG) or the Combined Heat and Power Act (KWKG) (part of GVP 2019 VIII. Civil Senate No. 1a), is on September 1st 2019 on the newly created XIII. Civil Senate passed over.
