VI. Civil Senate of the Federal Court of Justice

The VI. The civil senate is a panel of the Federal Court of Justice . It is one of thirteen senates currently dealing with civil matters.

He is mainly responsible for the law of unauthorized acts (e.g. traffic accident cases, product and doctor liability).

Jurisdiction

According to the BGH's business distribution plan (as of 2015), VI. Civil Senate (unchanged since 2012) responsible for:

  1. the legal disputes over claims from unauthorized acts , unless the I. Civil Senate (No. 1), the II. Civil Senate (No. 1 e, f, h and i), the III. Civil Senate (No. 1, 2 and 10), the V Civil Senate (No. 1 b, e and h) or the VII Civil Senate (No. 3) is responsible for claims for damages from medical treatment of humans and animals, even if they based on a contract, claims for damages from §§ 84 ff of the law on the trade in medicinal products as well as claims from the right to one's own image (§§ 22 ff KunstUrhG) and from the Federal Data Protection Act ;
  2. the legal disputes over claims from accidents in which an aircraft, a motor vehicle, a railway or a tram are involved, even if they are based on the transport contract , but with the exception of the freight contracts belonging to the jurisdiction of the 1st Civil Senate (No. 6) Goods;
  3. the legal disputes over claims from the Product Liability Act of December 15, 1989 ( Federal Law Gazette I, p. 2198 ) as well as from the Law on the Regulation of Genetic Engineering of December 16, 1993 ( Federal Law Gazette I, p. 2066 );
  4. the legal disputes about claims from the Environmental Liability Act of December 10, 1990 ( Federal Law Gazette I, p. 2634 ), unless further claims are asserted based on other regulations (Section 18 (1) UmweltHG) or another legal area is the actual subject of the dispute;
    1. maritime affairs (§§ 476 ff HGB) as well as inland waterway and rafting matters ( BinSchG ) with the exception of freight transactions,
    2. the legal disputes arising from towing contracts or from the collision of watercraft with other objects, including remote damage,
    3. legal disputes arising from insurance (including reinsurance) of watercraft and from cargo insurance for transport by sea or in inland waterways alone or in connection with land transport, insofar as the main focus of the legal dispute in the appellate body is nautical issues,
    4. the legal disputes arising from the law on rights to registered ships and ship structures of November 15, 1940, on possession and ownership of ships and ship structures,
    5. the legal disputes over ship liens and foreclosure in ships (§§ 162 ff ZVG);
  5. Legal complaints according to § 70 FamFG in
    1. the corporate law proceedings mentioned in § 375 No. 2 FamFG, unless the 1st Civil Senate (No. 11) is responsible,
    2. Public notice matters relating to the call-up of the owner of ships and shipbuilding works, the creditor of ship liens and the ship's creditor;
  6. Legal complaints insofar as it concerns the keeping of the ship registers , inland shipping registers and shipbuilding registers and other powers of the register judge.
