European Case Law Identifier

The European Case Law Identifier (ECLI, dt . : European case law identifier) ​​is a classification system and a standardized identification option (standard identifier) ​​for decisions of the courts of the member states of the European Union , the Court of Justice of the European Union , the European Patent Office and all other interested states and international organizations . The legal basis is the Council conclusions with a call for the introduction of the European Case Law Identifier (ECLI) and a minimum set of uniform metadata for case law (2011 / C 127/01) of April 29, 2011. The ECLI project itself was launched on April 27, 2011 Launched October 2011.

The unmistakable identification is made by the fact that the code (standard identifier) ​​consists of five parts separated by a colon , which are only assigned once in their combination.

The introduction of the ECLI is not intended to create a database at European level. The ECLI is part of the " E-Justice " system - see also the European Justice Portal .

The concept is similar to the "neutral citation" known from the Anglo-American area (see case citation in the English Wikipedia), depending on the formation of the fifth ECLI element more (e.g. Netherlands) or less (e.g. Germany).

Conception

The ECLI as an identifier was designed against the background of the Functional Requirements for Bibliographic Records (FRBR). The FRBR distinguishes ten different entities that can be the subject of bibliographic cataloging. In group 1, these entities will be between the work ( work expression () expression ), manifestation ( manifestation ) and copy ( item ) distinguished. In relation to a court decision, the work level (first level) describes the decision itself in an abstract sense. This decision can be available in different versions (“expressions” - e.g. and abbreviated or abbreviated, anonymized or not anonymized, in the original language or in a translation - second level). The respective "expression" of the decision can be manifested in various ways (third level), for example as a paper copy signed in the original by the judge, as a PDF file, as a graphic or as a print in a specialist journal. The specific copies of the manifestation, for example a specific file or a specific volume of a decision collection, are ultimately on the fourth level.

Within this level, the ECLI should identify the respective decision at the highest, the plant level. It should therefore characterize the decision itself, not a certain language variant or media form.

Structure and use

ECLI

The structure of the ECLI is uniform and may not be changed, shortened or extended by the EU member states or the users without authorization:

ECLI:[Ländercode ]:[Gerichtscode ]:[Jahr der Entscheidung]:[einmalige Kennung] .

Example: ECLI : NL : HR : 1919 : AG1776 = Decision of the Supreme Court (HR) of the Netherlands (NL) from 1919 with the identification of the Union Member State for this judgment AG1776.

The fifth element, unique identifier , is mentioned in the Council Conclusions (2011 / C 127/01) ordinal number, but letters are also permitted there (Appendix § 1 No. 5); Existing national identification systems for court decisions should be integrated as far as possible into the ECLI (Annex § 3.1 No. 3). There are basically two variants to be distinguished:

  1. Assignment of a consecutive number (e.g. EU , ES , FI , HR , MT , NL , SK )
  2. Formation based on the file number (e.g. BG , CZ , EE , PT , SI ), possibly also the decision date (e.g. CE , EP , DE , EL , LV ).

The advantage of a consecutive ordinal number, as it is also common in the Anglo-American "neutral citation", lies in its brevity and thus easier handling for the user. The advantage of using file numbers as a basis for a non-existent system of consecutive numbering lies in the lower administrative effort on the part of the provider and the associated easier extension to the past (although, of course, because of the possibility that several decisions by the same court and type of decision are issued on the same day under the same file number A collision number is necessary to maintain the uniqueness).

Metadata

The classification system also contains a series of standardized metadata to improve or facilitate the search. The minimum standard was specified by the Council of the European Union .

1. Required metadata are:

  • identifier (a URL under which this instance document or information about it can be found);
  • isVersionOf (ECLI = standard identifier);
  • creator (full name of the court. Name of chamber or department can be added);
  • coverage (country in which the court is located, possibly also information for part of a (federal) state);
  • date (date of the pronouncement of the judgment according to ISO 8601);
  • language (language);
  • publisher (organization responsible for publishing the document);
  • accessRights ("public" or "private". Documents declared as "public" must be freely accessible at the specified Internet address);
  • type (information on the type of decision, e.g. "court decision").

2. Supplementary metadata are or can be:

  • title (title, preferably the name of the parties or an alias for them - in accordance with national data protection regulations);
  • subject (legal area from which the decision originates, e.g. civil law , commercial law , family law , insolvency law , international private law , criminal law , EU law , administrative law , tax law , international law and constitutional law );
  • abstract (brief summary of the case);
  • description (key terms or catchwords for the decision);
  • contributor (names of judges, advocate general, and other officers involved);
  • issued (date of publication of this document);
  • references (references to other documents, in the case of judgments and, if available, the ECLI, in the case of EU legal acts the CELEX number, references to national legal acts, judgments without an ECLI or scientific publication, the URL or other identification);
  • isReplacedBy (if decisions are renumbered, the new ECLI is entered here).

Possible characters for the identifier

Only the Latin alphabet and Arabic numerals may be used to enter the data . Upper and lower case is permitted, provided that upper and lower case letters do not have different meanings in the corresponding electronic information system. It should preferably be written in capital letters.

administration

The Council of the European Union (Council of Ministers) is responsible for the changes and further development of ECLI. The European Commission is responsible for the ECLI website and ECLI search interface as well as for assigning the "country codes" used to the international organizations that want to use the system.

ECLI coordinator

Each Member State using the ECLI must designate a government or judicial body as a national ECLI coordinator. Each country can only have one ECLI coordinator. The ECLI coordinator for the EU is the Court of Justice.

Introduction in the Union Member States

The EU member states and all other states are free to introduce and use the ECLI.

If the ECLI is introduced in a member state of the Union, the following criteria must generally be applied (recommendations):

  1. Member States should apply the ECLI to all decisions made by all their courts;
  2. You should provide a minimum of metadata to all court decisions published on public websites.
  3. You should appoint a national ECLI coordinator.
  4. The EU Court of Justice should participate in the ECLI system.
  5. The European Commission should set up the ECLI website as part of the e-Justice portal.
  6. The European Commission and the Member States should work closely together to set up a network query for identifiers and metadata.
  7. Member States and their courts should disseminate information on the ECLI, the ECLI website and the search interface through their national websites and publications, even if they have not yet implemented the ECLI.
  8. Apart from the member states, the applicant countries and the Lugano states are also invited to use the ECLI system.
  9. Member States should report annually to the Council on the progress made in implementing the ECLI and metadata for case law.

ECLI search engine

Implementation of ECLI at the individual participants

According to the Council conclusions, Member States are free to choose to implement ECLI in their national systems. International organizations can also participate and apply for a "country code" from the European Commission. In addition to the courts of the EU, the Council of Europe ( ECHR ) and the Boards of Appeal of the European Patent Office, the ECLI will be available in Belgium, Bulgaria, Germany, Estonia, Finland, Croatia, Latvia, Malta, the Netherlands, Austria, Portugal, Spain, the mid-2020 Slovakia, Slovenia and the Czech Republic in use; at least for higher courts also in France, Greece and Italy. There is an elaboration for Romania, which - as far as can be seen - is not applied. Denmark, Ireland, Lithuania, Luxembourg, Poland, Sweden, Hungary, the United Kingdom and Cyprus, as well as Iceland, Norway and Switzerland are currently (2020) not participating.

EU - European Union

The Court of Justice of the European Union is the ECLI coordinator for the EU. ECLI was introduced on March 24, 2014 for decisions of the General Court and Opinions of the assigned Advocate General . As with the case numbers, “C” stands for Cour de justice / ECJ , “T” for Tribunal / EuG and “F” for fonction publique / public service ( EuGöD , a former specialized court ).

The European courts do not use the prefix “ECLI” when citing “in the interest of the most concise information possible”; Examples:

DEC stands for Decision (decision on the admissibility), JUD for Judgment (judgment in the main matter). Opinions (as in case P16-2018-001) do not receive an ECLI.

EP - European Patent Organization

The European Patent Office introduced the ECLI retrospectively in 2013. The ECLI coordinator in the European Patent Office is the Publication Department.

AT - Austria

In Austria , the introduction to ECLI started in early 2014. The national ECLI coordinator in Austria is the Federal Ministry for Digitization and Business Location .

In the legal information system of the Republic of Austria , not only decision texts (TE), but also legal sentences (RS) derived from them contain ECL identifiers. Legal clauses are condensed compilations of the essential statements of a court decision (cf. guiding principle ).

In ordinary jurisdiction, each legal sentence of a court is given its own identifier, to which various decision texts can be assigned.

At the Higher Administrative Court, the same legal sentence is given different identifiers, each derived from the identifier for the decision text; reference is made to the basic legal principle (so-called GRS clause; GRS = same legal principle).

The Czech Republic started implementation in April 2012.

    • CZ country code (CZ for the Czech Republic);
    • NS is the abbreviation (code) of the court that made the decision (NS for the Supreme Court);
    • 2012 indicates the year in which the decision was made;
    • 6.TDO.1416.2012 is the national file number [spisová značka] - without spaces and slashes; these are replaced by points;
    • the last number (in the example "1") indicates the consecutive number of decisions under one and the same reference number. By specifying the serial number, it is ensured that the same ECLI number is not assigned to several decisions by a court in the same year.

DE - Germany

Germany began introducing the ECLI on September 23, 2013. The national ECLI coordinator in Germany is the Federal Legal Information System Competence Center (CC-RIS) at the Federal Office of Justice in Bonn .

The ECLI is officially awarded at the BVerfG and BVerwG comprehensively, with the BSG from 2010, the BAG from 2015, the BGH and BFH from 2016 and the BPatG from 2017; also in the decision databases of the federal states of Berlin, Brandenburg, Hesse, Lower Saxony, North Rhine-Westphalia, Rhineland-Palatinate and Schleswig-Holstein. "0A" as a two-digit collision number indicates with automated allocation that the existence of further decisions from the same day was not checked.

In Estonia , the ECLI identifier has been added to all rulings of the Supreme Court ( Riigikohus ) and rulings by the two district and four regional courts since 2016 .

Greece participates in the ECLI system with the Council of State .
