Service court for judges

from Wikipedia, the free encyclopedia

A service court for judges is the highest professional court of a German state for disciplinary and service law questions from judges of the regional courts. The legal basis are Sections 77 to 79 of the German Judges Act and the judge laws of the federal states. For federal judges , a special senate of the Federal Court of Justice is exclusively responsible as the federal service court.

With a chairman , two permanent and two non-permanent assessors , the service courts negotiate and decide on appeals against judgments and on complaints against decisions of the service courts for judges, as well as in all cases in which the judges' law of the respective country and the procedural regulations to be applied thereafter have jurisdiction of the court of second instance .

The members of a service court for judges are composed of different branches of the judiciary , with judges from ordinary and administrative jurisdiction always being represented. The court decides with a chairman, two permanent assessors and two non-permanent assessors. The non-permanent assessors belong to the court branch of the judge affected by the proceedings.
