Legal Secretary

A legal secretary is in Germany with the trade union active lawyer or a labor law expert person with both the extrajudicial advice in all matters relating to the labor law as to the representation of trade union members in the courts of labor and social jurisdiction is responsible. According to Section 11 (2) of the ArbGG , legal secretaries may appear before the labor courts , regional labor courts (LAG) and the Federal Labor Court (BAG) even without admission as a lawyer . If you want to appear before the Federal Labor Court, you must, however, have the qualification for judicial office according to § 5 DRiG .

The legal protection secretary of a limited liability company is not entitled to consent to take up a secondary activity as a lawyer if an overlap of the two activities is to be feared.
