Joint council

The Samtgemeinderat is by the Lower Saxony Gemeindeordnung the representative body of Lower Saxony Samtgemeinde and adjacent to the integrated municipality Mayor and the integrated municipality Committee one of its three organs (§ 75, para. 1 NGO). Since the organs of a joint municipality correspond to those of a municipality, the regulations on the municipality council (Section 71, Paragraph 1 NGO) are to be applied in full to the joint municipality council.

The Samtgemeinderat decides on the name, the coat of arms to be used and other changes to the main statute of a Samtgemeinde. The regulations governing the election of its members also correspond to those of the municipal council: every German and Union citizen who has reached the age of 16 has the right to vote . Both adult Germans and adult Union citizens who have been resident in a member municipality of the integrated municipality for at least six months are eligible. Civil servants in particular are excluded from the right to stand for electionand full-time employees of the joint municipality or one of its member municipalities. The number of council members is based on the population of the entire municipality and, assuming a target of at least 7,000 inhabitants, can vary between 20 and 66.
