The desecration ( French Actes d'ordre sexuel commis sur une personne incapable de discernement ou de résistance , Italian Atti sessuali con persone incapaci di discernimento o inette a resistere , Rhaeto-Romanic Dischonuraziun ) is one of Article 191 of the Criminal Code (StGB) in Switzerland . defined offense against sexual integrity .

Offense

The offense of desecration is fulfilled if the perpetrator carries out sexual acts on a person who is incapable of judgment or who is incapable of resisting, knowing this state of affairs. This condition can be caused by binge drinking , drug use or anesthetics , but it can also have medical causes such as coma , stupor , paralysis or intellectual disabilities .

In the case of vaginal penetration, a distinction must be made between rape according to Article 190 of the Criminal Code and, in general, sexual coercion according to Article 189 of the Criminal Code.

Desecration can be punished with up to ten years ' imprisonment or a fine at the discretion of the court .
