The railway control is the independent regulator of the railways in Austria .

The liberalization of the rail transport market decided by the European Union brought about an opening of the rail networks in the course of the implementation of Council Directive 91/440 / EEC of July 29, 1991 on the development of the Community's rail companies. The aim of liberalization is the entry of new companies into the rail transport market, the stimulation of competition between the rail transport companies and the efficient use of the rail network. The purpose of the regulation is to create and guarantee equal and functional competition between railway undertakings by lowering barriers to market entry, carrying out market analyzes , ensuring open network access or mediating disputes between market participants.

In 1999, Eisenbahn-Control GmbH and the Eisenbahn-Control Commission , an independent administrative authority consisting of a chairman, who belongs to the judiciary, and two other members, were entrusted with the performance of regulatory tasks in Austria . The shares in Eisenbahn-Control GmbH are reserved for the federal government.

The tasks of the regulator are regulated in the Austrian Railway Act. These tasks include, among other things, the exercise of competition supervision, market observation, arbitration and decision-making on complaints from railway companies regarding access to the rail infrastructure and other services such as railway stations and technical facilities and access to and shared use of connecting railways .

Arbitration Board

Rail Control GmbH has also set up the state arbitration board for passenger rights , to which customers of railway companies can turn who are dissatisfied with the decision of the railway company in a complaint case. The rail control commission can declare the conditions of a railway company with regard to compensation payments in the event of train delays ineffective in whole or in part.

Passenger and passenger rights agency

Since 2015, the Agency for Passenger and Passenger Rights (apf) has been organizationally assigned to Eisenbahn-Control GmbH in accordance with the Passenger and Passenger Rights Agency Act (PFAG).
