Schwippschwager
The legally undefined term of Schwippschwägerschaft is a common term for the so-called distant brotherhood . Schwipp-brother-in-law or sister-in-law (in some parts of Austria called brother-in-law and sister-in-law ) are therefore not blood relatives who, as relatives of spouses or life partners, are in a family relationship that has been mediated over several degrees .
This particular the ratio of the siblings of one of the siblings of the opposite marriage - or life partner meant and the relationship between the spouses or partners of siblings.
In a broader sense, the term is also extended to other distant relationships, e.g. B. siblings, uncles and aunts of children-in-law as well as uncles in law and aunts of the spouse or partner. Occasionally counter-in-law parents (parents of the child-in-law) and step-siblings are also referred to as Schwipp-in-law.
Examples
Siblings of brother-in-law / sister-in-law: Anton marries Claudia. On the one hand Anton and Bernd, on the other hand Claudia and Claudio are siblings. Claudia is Bernd's sister-in-law (brother's wife). Then Bernd and Claudio are Schwippschwäger.
Husband of brother-in-law / sister-in-law (South German Geschwei ): The term is also applied to the relationship that exists between the spouse or partner of one sibling and the spouse or partner of the other sibling: Dora marries Bernd. And Anton, Bernd's brother, is also married, namely to Claudia. Bernd is Claudia's brother-in-law (spouse). Then Claudia and Dora are Schwipp sister-in-law.
For better memorization, the following can be formulated: Schwippschwäger (inside) are siblings of the spouses of their own siblings or spouses of siblings of their own spouse.
etymology
According to a folk etymological interpretation, the prefix Schwipp- should mean “to sway, slosh”. The "Schwippschwägerliche" relationship is characterized by the fact that, depending on the direction from which the relationship is viewed, one partner is always brother-in-law and the other Schwipp -brother-in-law ( so to speak swing or slosh ) Schwipp-brother of the other partner's siblings. Similarly, the sister of one partner is also the sister-in-law of the other partner and sister-in-law of the other partner's siblings.
In reality, however, it is either a shortening of the word sister ( brother-in-law ) or a reduplication of the initial sound of brother-in-law (cf. the formation of gritzegrün ).
Legal
According to § 1590 BGB , a relationship in the legal sense only exists between the spouse and the (blood) relatives of the other spouse. The same applies in accordance with Section 11 LPartG . Thus, Schwippschwäger have no right to refuse to testify and the rules of bias that apply to by-laws are not applied to Schwippschwäger. Due to European law, this also does not apply to public procurement: here even related persons and persons by marriage are only considered biased in certain cases; they are “biased persons” within the meaning of Section 6 (4) of the Vergabeverordnung (VgV).
