Social charter

As part of the privatization of public housing stocks, conditions are agreed as social charter or social clauses , which give tenants protection that goes far beyond the statutory provisions. The agreed duration varies and is usually 10 to 15 years. The social charter is binding for every interested party / investor in the field of public housing and is contractually fixed in the event of a sale. These social charter are an expression of the positive intentions of the investors and illustrate the interest in keeping the tenants in the apartments. Only a low vacancy rate secures the rental income required to secure the investment.

The following points are generally regulated by a social charter:

  • Protection against dismissal
  • Rent increases are restricted / binding to the rent index (also for new rentals)
  • Special regulations for publicly subsidized apartments
  • Renovations are regulated and luxury renovations are often excluded
  • Individual contractual rights for each tenant
  • Securing of occupancy rights
  • Continuation of tenant participation
  • Social security for the employees of the former municipal housing company
  • Rules and conditions for tenant privatization
