Stera Mahkama

The Stera Mahkama (also Estera Mahkama) ( Pashto : ستره محكمه) is the Supreme Court of Afghanistan . It is mentioned in the Afghan Constitution in Articles 116 to 119, 121, 132, 133 and others.

Duration

The Supreme Court consists of nine judges. After a transitional period in which the appointments are valid for different lengths of time, the judges are appointed for ten years each. According to Article 117 of the Constitution, the judges are appointed by the President of the Republic with the consent of the deputies of the Wolesi Jirga .

The Supreme Court consists of four chambers (Dewan): General Criminal Dewan, Public Security Dewan, Civil and Public Rights Dewan, and Commercial Dewan.

According to Article 3 of the Constitution, “no law may contradict the beliefs and provisions of the holy religion of Islam”. According to Article 130 of the Constitution:

"(...) If no provisions can be found in the constitution and other laws in a case pending decision, the courts must make their judgments within the limits of this constitution in accordance with Hanafi legal doctrine ( Fiqh ) in such a way that justice is based is served in the best possible way. "

For Shiite believers, however, according to Article 131, the Shia legal code applies to personal matters.

According to Article 132 of the Constitution, the Stera Mahkama also has the right to nominate all judges, who are then confirmed by the President. The appointment itself and the exercise of other rights vis-à-vis the judges are carried out by the judges of the Supreme Court.

According to Articles 144 and 145, the Supreme Court has the right to cooperate in the event of a state of emergency.

The head of the Research and Study Center of the Stera Mahkama is Mohammad Osman Zhobel . The spokesman for the Stera Mahkama is Wahid Muzhda and his deputy is Muhammad Sidiq Zhobel.

In December 2001, leaders of the United Front and Afghan groups in exile met at the Petersberg Conference in Bonn, where they agreed on the so-called "Petersberg Agreement". Among other things, this provided for the establishment of the Stera Mahkama.
